Preamble
We, the Tangkhul Naga students in Delhi having solemnly resolved to constitute into a union in conformity with the constitution of the Naga Students’ Union, Delhi, committing ourselves to look into the affairs and the conduct of the Tangkhul Naga Community; to cultivate and instill excellence in the pursuit of education; to enhance a strong and progressive outlook; to preserve, promote and uphold socio-economic and cultural heritage; and to strengthen and consolidate the fraternity, unity and integrity of the Tangkhul Naga community in particular and the Naga community in general, the assembly of the General Body Meeting hereby adopt, enact and give to ourselves this constitution on this 27th day of May 2003.

Articles of the Constitution
Article 1 (One): Nomenclature
The name of the Union shall be called Tangkhul Katamnao Long, Delhi
Article 2 (Two): Motto
Build a Better Tomorrow
Article 3 (Three): Emblem
It consists of a tarung and a man and a woman on each side of the tarung within a circle. The tarung is a traditional cultural symbol of nobility, merit and status, and it reminds us of the enduring legacy of the community feasts of merit which foster a sense of belonging and oneness. The man with a kazei (spear) and the woman with a zeithing (traditional steel-coated iron staff exclusively meant for women) sported in colourful traditional attires signifying youthful spirit of guardianship and keeping alive the culture and identity of the Tangkhul Naga community. They symbolize a quest for and dissemination of wisdom and knowledge, thereby engaging the pursuit of learning and knowledge as a social heritage. The circle represents the universe and the world of which we are a part.
Article 4 (Four): Flag
There shall be a flag of the union. The background of the flag shall be sky blue signifying universality; and the union’s emblem shall be placed at the centre of the flag.
Article 5 (Five): Membership
(a) All Tangkhul Naga students living in and around National Capital Region of Delhi shall be members of the Union. (b) All members shall be a bonafide Tangkhul Naga (i.e. a member of any Tangkhul Naga clan). (c) All members must get himself/herself registered with the Union. (d) Loss of Membership: Any member of the Union would lose his/her membership on violation of the Constitution.
Article 6 (Six): Jurisdiction
(a) The jurisdiction of the Tangkhul Naga Katamnao Long, Delhi shall cover the NCR of Delhi. (b) The Tangkhul Naga Katamnao Long, Delhi is the apex Tangkhul Naga students’ organisation in the NCR. There shall be no other Tangkhul Student Organisation(s) in the NCR of Delhi. (c) The Union shall discourage any activities or propaganda which may breed regionalism and foster divisive forces in the society. No individual member or group of members shall organize any Tangkhul social and cultural programme without prior information and approval of the Union. There shall be no region-based (Raphei, Kharao, Kamo, etc.) social activities. (d) The Union is empowered to take steps and actions in the event of any individual or group(s) or organization(s) working against the interests and integrity of the TKLD. (e) Only the TKLD shall have the right to any monetary collection from the members for the activities/functioning of the Union. (f) The Union shall seek and receive contribution from its members, well-wishers, institutions and other organizations for its functioning.
Article 7 (Six): Official Language
(a) The official languages of TKLD shall be Tangkhul and English. (b) All official communication of the Union shall be made in either of the official languages.
Article 8 (Seven): General Body Meeting (GBM)
(a) The General Body Meeting constitutes the highest decision making body of the Union. (b) There shall be at least two general body meetings in one calendar year-tenure. (c) The quorum of GBM shall be formed by 3/4th of the members of the Executive Council, 1/4th of Coordinating Secretaries and 30 members. (d) In case of grave issue(s) affecting the Union and its member (s) and amendment(s) affecting the basic tenets and fundamentals of the constitution, the GBM will require a special quorum consisting of 2/3rd of Coordinating Secretaries, 2/3rd of the members of the Advisory Board, 3/4th of the members of the Executive Council and 60 members. (e) The Speaker may reject or accept agenda(s) in consultation with the Executive Council. (f) In the event of tie of votes, the speaker shall cast his/her vote. (g) Emergency Provision of GBM:- In the event of certain cases/issues, which require immediate deliberation and prompt action, the speaker may call for an emergency GBM in consultation with the Executive Council, Advisory Board and Action Committee. (h) Any decision(s) taken in a GBM cannot be overruled except by another GBM of larger number. (i) If the proposed GBM cannot be held for lack of quorum, a postponed meeting shall be held at any date not earlier than one week and not later than fifteen days after the date originally fixed. The meeting held after the postponement will require no quorum. (j) The house (GBM) shall determine the allowance of the Executive Council for each tenure.
Article 9 (Nine): Executive Council
(a) There shall be an executive body of the union, which shall be called Executive Council. (b) The Executive Council shall consist of the following members: (i) President (ii) Vice President (iii) General Secretary (iv) Joint-Secretary (v) Finance Secretary (vi) Social and Cultural Secretary (vii) Games and Sports Secretary (viii) Public Relation Secretary (ix) Women Co-ordinator (x) Accountant
Article 10 (Ten): Qualification for the Candidates of the Executive Council
(a) The candidate must be a bonafide and registered member of TKLD. (b) The candidate must not be a full time employee of any recognized institution. (c) The President, the VP, GS and Jt. Secy. should be at least graduates, and the rest should be 10+2 and above. (d) The candidate must have completed a minimum stay of at least two years in the NCR of Delhi. (e) The candidate must not be a married person.
Article 11 (Ten): Powers, Functions and Duties of the Executive Council Part A: The Executive Council
(a) The Executive Council shall execute the decisions of the GBM. (b) The Executive Council shall conduct meeting at least once in two months and the quorum of such meetings shall be at least 3/4th of the members of the Executive Council. (c) There shall be Co-ordinating Secretaries of different areas who shall function as long as they enjoy the confidence of the Executive Council, the number and areas of which shall be decided by the executive council, the matter of which shall be intimated to the House. The Coordinating Secretaries shall function as per the terms of reference prescribed by the Executive Council. (d) The Executive Council shall organize workshop and seminars whenever and wherever necessary. (e) The Executive Council shall organize orientation programmes and give guidance in admission processes. (f) The Executive Council shall organize annual get-together (Yathot Kazip) of the Union. (g) The Executive Council shall organize the annual games and sports of the Union. (h) In case of unforeseen event(s) the Executive Council may collectively sanction an appropriate amount as so required.
Part B: Powers and Functioning of the Executive Member(s)
(I) President (a) The President is the head of the Executive Council. (b) The President shall summon all the meetings of the Executive Council. (c) The President shall execute the powers and functions of the union in consultation with the members of the Executive Council, which will reflect the collective decision of the Executive Council. (d) The president shall either accept or reject resignation tendered by any member(s) of the Executive Council or Committee(s) in consultation with the Executive Council and forward the matter to the house in a GBM of the union for approval. (e) The President shall be empowered to sanction an amount (which shall be decided by the GBM) as deem fit and proper during his/her tenure, and shall give the report of the same to the Finance Committee.
(II) Vice President (a) The Vice-President shall assume all the powers and functions of the president during his/her absence/impeachment. (b) The Vice-President shall discharge the responsibilities of the union as may be assigned by the president. (c) The Vice-President shall head in the affairs of admission processes, and shall be a co-editor of the publications of the union’s magazine and other literary works.
(III) General Secretary
(a) The General Secretary (GS) shall record and maintain all minutes and proceedings of the union’s meetings. (b) The General Secretary shall co-ordinate and supervise the activities of the Coordinating Secretaries. (c) The General Secretary shall be responsible for all the official correspondence of the union. (d) In the absence of the President and Vice-President, the GS shall head the Executive Council.
(IV) Joint Secretary
(a) The Joint Secretary shall assume the powers and functions of the general Secretary in the event of the latter’s absence or impeachment. (b) The Joint Secretary shall discharge the responsibility of the union as and when assigned by the President or General Secretary from time to time. (c) The Jt. Secy. Shall be in-charge of the Union’s Resource Centre.
(V) Finance Secretary
(a) The Finance Secretary shall prepare the annual budget of the union and present it before the first GBM of each tenure for necessary deliberation and approval. (b) The Finance Secretary shall be the chairperson of the Finance Committee of the Union. (c) The Finance Secretary shall be trustee of the Union’s treasury and the disbursing officer.
(VI) Accountant
(a) The Accountant shall record and maintain all the financial transactions of the union. (b) The Accountant shall present the financial status of the union quarterly before the Executive Council.
(VII) Social and Cultural Secretary (SCS)
(a) The SCS shall be responsible for organizing and promoting cultural and social activities. (b) The SCS shall duly discharge the responsibilities of the union when assigned by the Executive Council.
(VIII) Games and Sports Secretary (GSS)
The GSS shall be responsible for maintaining, upgrading and organizing the annual games and sports of the union.
(IX) Public Relations Secretary (PRS)
(a) The PRS will be responsible for the publicity of the union’s programmes and policies. (b) The PRS shall maintain the census of the union. (c) The PRS shall work for the promotion of good relations and co-ordination with other organizations.
(X) Women Coordinator (WC)
(a) The WC shall undertake the role of co-ordinating the participation of women members in the activities of the union. (b) The WC shall be responsible for initiating agenda(s) from the women as and when need arises. (c) In the absence of a female member in the Action Committee during the time when an action is initiated, the WC shall act as a member of the Action Committee.
Article 12 (Twelve): Selection Committee
There shall be a seven member Selection Committee consisting of five members of the union nominated by the house and two members of the Executive Council (viz. President and Women Coordinator). The Selection Committee shall appoint the Speaker and Deputy Speaker, the members of the Action Committee, Advisory Board, Action Committee, Khanrin Editorial Team and Election Commission. The President shall be the Chaiperson of the Selection Committee, and one of the non-executive members of the Committee shall be the Secretary of the Committee.
Article 13 (Thirteen): Speaker and Deputy Speaker
There shall be a Speaker to reside over the house; and there shall also be a Deputy Speaker to take charge of the Speaker in the latter’s absence.
Power and Functions
I. Speaker
(a) The Speaker shall summon all the GBMs of the union in consultation with the Executive Council. (b) The Speaker shall maintain decorum, adjourn and prorogue the meeting and initiate disciplinary actions against members indulging in unruly behaviour. (c) The Speaker shall decide the nature of GBM and the quorum there-upon as per the constitution. (d) In case of lack of quorum the Speaker shall adjourn the house; and in such case(s) the Speaker shall summon the next GBM as per Clause (i) of Article 8 of the constitution of the union. (e) The petition of No Confidence Motion against the Speaker shall be submitted to the Deputy Speaker who shall convene a GBM in consultation with the Executive Council and in the absence of the Deputy Speaker, the petition shall be submitted to the Executive Council. (f) In the circumstantial absence of both the Speaker and the Deputy Speaker, GBM shall be summoned by the Executive Council, and in such matter the house shall nominate a protem-speaker for the GBM. (g) The Speaker shall continue his/her tenure until the appointment of a new Speaker after the election of a new Executive Council.
II. Deputy Speaker
(a) The Deputy Speaker shall assume all the powers and functions of the speaker during his/her absence/impeachment. (b) The petition of No Confidence Motion against the Deputy Speaker shall be submitted to the Speaker who shall convene a GBM in consultation with the Executive Council, and in the absence of the Speaker the petition shall be submitted to the Executive Council. (c) The Deputy Speaker shall continue his/her tenure until the appointment of a new Deputy Speaker after the election of a new Executive Council. Qualification
The Speaker and the Deputy Speaker should be at least graduates with a minimum stay of three years in the NCR of Delhi.
Article 14 (Fourteen): Finance Committee (FC)
(a) The Finance Committee shall be responsible for any monetary collection of the Union. (b) The Coordinating Secretaries shall constitute members of the Finance Committee. (c) The Finance Secretary shall be the Chairperson of the FC. (d) Bank Accounts of the union shall be jointly operated by the President and the Finance Secretary.
Article 15 (Fifteen): Audit Committee
(a) There shall be an Audit Committee comprising of three members before the end of the Executive Council’s tenure constituted by the GBM. (b) The Audit Committee shall audit all accounts and financial transactions of the Union and shall submit the report to the GBM for necessary scrutiny and approval. (c) The Audit Committee shall continue its tenure until the constitution of new body.
Article 16 (Sixteen): Action Committee (AC)
(a) There shall be an Action Committee of the Union. (b) The Action Committee shall execute Article 19 of the Union. (c) The Action Committee shall consist of five members of which at least one of the members shall be woman. (d) The Action Committee shall look into the grievances and various problems faced by the members of the union. (e) The Action Committee shall continue its tenure until the constitution of new body.
Article 17 (Seventeen): Advisory Board (AB)
(a) There shall be an Advisory Board of the Union. (b) The Advisory Board shall consist of five members, of which at least one of the members shall be a woman. (c) The Advisory Board shall aid and advise the Executive Council as and when the need arises. Its aid and advices shall be advisory in nature and not binding on the Executive Council. (d) In the event of en-mass resignation, constitutional crisis, No Confidence Motion against the whole Executive Council, etc., the Advisory Board shall act only as caretaker and work for the return to normalcy. During such situation they shall not be entitled to take any major decision. (e) The Advisory Board shall continue its tenure until the constitution of new body.
Article 18 (Eighteen): Khanrin
(a) There shall be a Team of Editor and two Co-editors, one of whom shall be the Vice-President of the Union, responsible for the publication of the union’s magazine – Khanrin. (b) The Team shall look into the Website and other media-related activities of the Union.
Article 19 (Nineteen): Emergency Fund
(a) The Emergency Fund is distinct fund and should not be merged with the General Fund. (b) The Finance Secretary is the Trustee of the Emergency Fund. (c) No transaction of any amount from the Emergency Fund should take place without the knowledge of the President of the Union. (d) Terms and conditions for borrowing money from the Emergency Fund i) The borrower must bring two witnesses; ii) The two witnesses as well as the borrower must deposit their Original Mark-sheets (Class X) in the hands of the Finance Secretary and President of the Union; iii) In case the borrower is unable to pay back the money in a month time, 5% interest will be charged from the second month onwards; and if he/she is unable to pay back in the third month, his/her case will be published in the Khanrin; iv) The Borrower along with the two witnesses will take an undertaking in written with the TKLD representatives at the time of borrowing; the TKLD Executive Council shall prepare a special format for the purpose; v) The form shall carry the names of the borrower and his/her parents, names of the two witnesses and their parents, names of their respective villages with proper addresses. vi) Three copies of the form, one each for the borrower, his/her parents and the TKLD, are to be filled;
Article 20 (Twenty): No Confidence Motion (NCM)
(a) The members of the Executive Council shall hold office as long as they enjoy the confidence and faith of the house. (b) At least 50 or more members of the Union may move a NCM against one or more members of the Executive Council or any Committee by submitting a written petition to the Speaker stating the reason why the members concerned shall vacate the chair duly supported by substantial evidences thereupon the Speaker shall convene a GBM within 10 days to take up the motion. (c) In the event of No Confidence Motion (NCM) tabled against any Executive, the person shall relinquish his/her chair until his/her position is duly restored. In such circumstances, the Speaker shall decide the mode of voting. (d) The Executive member (s) against whom a No Confidence Motion (NCM) is moved may defend/ clarify before the house. The decision made by at least 2/3 of the members present and voting in the GBM shall be final and binding.
Article 21 (Twenty-one): Disciplinary Action- Rules and Functions
(a) Every member is expected to uphold the ideals and aspiration of the union’s Preamble in spirit and manner, which shall not disgrace the Tangkhul Naga community in particular and the Naga community in general. (b) If one or more members of the Union individually or collectively violates any part of the Constitution in words or otherwise, the Action Committee in consultation with the Executive Council shall proceed for necessary action against the defaulters as per the constitution of the union. (c) The Action Committee shall then proceed to investigate the matter within a period of 7 days from the receipt of such official information. (d) The report of the action taken shall be submitted to the Executive Council for record and documentation.
Article 22 (Twenty-two): Amendment of the Constitution
(a) Ten or more members of the Union may move for amending any part(s) of the Constitution by submitting a petition to the Speaker of the Union with a supportive explanatory note. (b) Any petition for amendment of the constitution shall be referred to the Speaker who shall either accept or reject the petition in consultation with the Executive Council. The accepted petition shall be tabled in the house for necessary deliberation for approval by at least 2/3rd of the members present and voting.
Article 23 (Twenty-three): Election
Part A: Election
The Election Commission shall conduct the general election of the union’s Executive Council within the month of February every year.
Part B: Election Rules and Procedures
(a) The Executive Member (s) is /are eligible for re-election up to two terms; any member of the Executive Council who has lost confidence of the house shall not be eligible for re-election. (b) The mode of voting in election of the Executive Council shall be secret ballot system. (c) In the event of post (s) declared vacant, by-election shall be conducted within a period of one month. However, if the post (s) still remains vacant after such election, the Election Commission in consultation with the Executive Council shall nominate candidates for such post (s) with approval of the GBM. (d) The Election Commission will have the power to disqualify the candidature of a candidate in case of violation of model code of conduct laid down by the Election Commission.
Article 24 (Twenty-four): Election Commission (EC)
(a) There shall be an Election Commission consisting of 3 (Three) members. The EC shall control, direct and supervise the election procedures. (b) The Electoral College shall elect the Executive Council and the Electoral College shall comprise of all members of the Union. (c) The EC shall be responsible for: (i) Announcement of date, time and place of election in consultation with the Executive Council. (ii) Preparation of Ballot papers, nomination papers and issuing the same. (iii) Preparation of electoral rolls. (iv) Scrutinising the nomination of the candidates. (v) Polling, counting and declaration of the result. (vi) Conducting mid-term poll, by-election etc. (vii) Ensuring free and fair election. (viii) Issuing necessary model code of conduct etc. based on the spirit and aspiration of the Constitution. (d) The Election Commission shall accept the nomination papers on the appointed date. The nomination papers for candidature shall be duly proposed and seconded by at least two registered members. (e) Withdrawal of candidature shall be done four days before the date of election. (f) The Election Commission shall accept the appointment of one person to be the counting agent of the candidate. (g) In the event of a tie in the election, the Election Commission shall decide by draw of lots. The decision of the Election Commission shall be final. (h) The Election Commission shall be responsible for conducting the election of the Executive Council. (i) The Election Commission shall continue their tenure till the constitution of new bodies.
Article 25 (Twenty-five): Representatives to the Naga Students’ Union, Delhi
The Representative to the NSUD shall be the President, the General Secretary and the Women Coordinator as per the Article 19 of the Constitution of the Naga Students’ Union, Delhi (NSUD).
Article 24 (Twenty-six): Naga Students’ Union, Delhi (NSUD) Election
(a) Candidature of the posts of President, General Secretary, and Vice-President of the Naga Students’ Union, Delhi’s Executive Council shall be discussed and approved by the house in the half-yearly GBM of the union (TKLD). Candidatures for the remaining posts shall also be intimated to the house for approval; however, they shall not be necessarily decided by the half-yearly GBM of the union (TKLD). (b) The Electoral College of the TKLD for/to the Election of the Naga Students’ Union, Delhi shall be the incumbent Executive Council of the TKLD.
